Nations and States
Because the U. Constitution establishes a federal system, the state governments enjoy extensive authority. The Constitution outlines the specific powers granted to the national government and reserves the remainder to the states. However, because of ambiguity in the Constitution and disparate historical interpretations by the federal courts, the powers actually exercised by the states have waxed and waned over time. Beginning in the last decades of the 20th century, for example, decisions by conservative-leaning federal courts, along with a general trend favouring the decentralization of government, increased the power of the states relative to the federal government. In some areas, the authority of the federal and state governments overlap; for example, the state and federal governments both have the power to tax, establish courts, and make and enforce laws. In other areas, such as the regulation of commerce within a state, the establishment of local governments, and action on public health , safety, and morals , the state governments have considerable discretion.

NCBI Bookshelf. Because crisis standards of care CSC responses will combine the efforts of health care, public health, and emergency management and response systems, they will necessitate interaction between public and private actors and resources and local, state, and federal authorities. While much of the health care component of a CSC response will occur in the private sector because the health care system comprises largely nongovernmental partners, with some exceptions , government at all levels must play a crucial role in leading and coordinating CSC planning and implementation efforts. Building on existing strengths, authorities, and response structures within states, this chapter outlines the roles and responsibilities of state and local governments in CSC planning and implementation in the overall context of a CSC response system. It focuses on the unique role of the state health department 2 in leading CSC efforts within states, and on the interplay of local health department, regional, state emergency management, and federal partners in state planning and implementation efforts for CSC incidents. Two templates provide core functions for state and local planners to help guide the development and, when needed, the activation and implementation of CSC plans.

The relationships among the federal, state, and local governments often confuse people, yet federalism is at the heart of critical battles over the nature and scope of public policy in the United States. Neighborhood schools are run by locally elected school boards but also receive state and national funds, and with those funds come state and national rules and regulations. We generally speak of three forms of governmental structures—federalism, unitary government, and confederation. It describes the ways that the federal system has changed over two centuries of American government and why American federalism is at the center of important battles over policy. Federalism is not the typical way by which nations organize their governments; there are only 11 countries with federal systems.
